THE LIMITATIONS OF LIABILITY SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN JET'S PIZZA AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY FOR CERTAIN TYPES OF DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY APPLICABLE LAW.

8. Indemnification

YOU AND JET'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. The arbitrator shall have no authority to award class-wide relief.

10.4 Jury Trial Waiver

FOR ANY MATTERS NOT SUBJECT TO ARBITRATION, YOU AND JET'S PIZZA MUTUALLY WAIVE ANY CONSTITUTIONAL OR STATUTORY RIGHT TO GO TO TRIAL BEFORE A JUDGE OR JURY. All such matters shall be resolved by a judge sitting without a jury.

11. Term and Termination
